Welcome to Nutrition Lab Sciences. The terms “we”, “us” and “our” refer to Nutrition Lab Sciences Pty Ltd (ACN 681 805 569). Nutrition Lab Sciences operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with our Privacy Policy and any other policies linked within, set out your rights and responsibilities when using the Services.

By visiting, interacting with, or purchasing through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

Section 1 – Access and account

You must be at least the age of majority in your state, territory, or country of residence to use the Services. You may allow your minor dependants to use the Services only with your supervision and on devices you own or control.

You agree to provide accurate, current, and complete information when creating an account or making a purchase, and to update it as needed. You are solely responsible for keeping your account login credentials secure and for all activity under your account.

Section 2 – Our products

We make every effort to ensure product descriptions and images are accurate. However, colours, appearance, capsule count displays, packaging images, and product presentation may vary due to device display differences, packaging updates, or launch-batch refinements.

Essentbio® Daily Capsules are supplied in jars containing 120 capsules, providing a 30-day supply when taken as directed: two capsules in the morning and two capsules in the evening.

Essentbio® Daily is listed in Australia as an AUST L complementary medicine to support general health and wellbeing. During the initial global launch period, Essentbio® Daily may be supplied to selected international destinations using the Australian label and packaging. Product classification, permitted claims, import rules, and labelling requirements vary by country.

While we take great care to ensure the quality of our products, we cannot guarantee that they will always meet every individual’s expectations. Product descriptions, specifications, pricing, formats, labels, and availability may change at any time without notice. We reserve the right to discontinue any product and to limit quantities available for sale.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or reject your order at our discretion. Orders are accepted once payment has been received and confirmed.

Essentbio® Daily Capsules may be supplied through one-time purchase, subscription, or other purchase options shown on the product page and checkout.

Unless otherwise stated:

  • Each jar contains 120 capsules and provides a 30-day supply when taken as directed.

  • Orders may be limited to a maximum of three jars per shipment to support fulfilment accuracy, customs clearance, and personal-use supply limits.

  • Flat-rate tracked shipping may be applied per shipment based on the recipient’s country or region.

  • Exact shipping fees, available purchase options, taxes, and checkout currency are displayed at checkout before you finalise your order.

  • Subscription orders renew according to the delivery frequency selected at checkout unless cancelled, paused, or rescheduled through your account portal before the next renewal is processed.

  • For supported launch destinations, shipping and checkout charges are provided on a duties-and-taxes-paid basis, with no additional payment required from the customer for applicable import duties, taxes, tariffs, or standard customs clearance charges connected with that order.

  • Your purchases are for personal or household use only and not for commercial resale.

We may restrict, cancel, or refund an order if we believe it may exceed personal-use limits, be unsuitable for a destination market, breach applicable laws, or create customs or fulfilment risk.

Section 4 – Prices and billing

Prices are subject to change without notice. The price charged will be the price in effect at the time of your order. Our stated product prices exclude shipping and handling unless expressly stated otherwise. For supported launch destinations, applicable import duties, taxes, tariffs, and standard customs clearance charges are included in the shipping/checkout charges shown at checkout, with no additional customer payment required for those charges.

Prices may be shown in different currencies depending on your selected market or checkout settings. Currency conversions may vary and are determined by our store, payment provider, or currency conversion provider.

You agree to provide valid and authorised payment details, and you authorise us to charge your nominated payment method for each purchase and, where applicable, each subscription renewal until cancellation. If payment fails, we may suspend or cancel your order or subscription until payment is received.

Section 5 – Shipping and delivery

Essentbio® Daily Capsules are available during launch in Australia and selected international markets, currently including the United States, Canada, the United Kingdom, Singapore, and selected European Union markets where fulfilment is enabled. Availability may change without notice based on customs requirements, logistics, regulatory considerations, or fulfilment capacity.

All orders are shipped from Australia unless otherwise stated. Australian orders are generally dispatched using Australia Post or another tracked domestic carrier. International orders are generally dispatched using DHL eCommerce, DHL Express, Australia Post international services, or another tracked courier or fulfilment partner selected for the destination.

We are scaling up our production and fulfilment capacity, and every order retains its place in our processing queue. Orders are fulfilled in the sequence they are received, and we work to dispatch each order as quickly as possible while maintaining our quality standards.

Delivery times vary by location and are subject to carrier transit times, customs processing, border clearance, and events outside our control. For supported launch destinations, orders are shipped on a duties-and-taxes-paid basis, meaning applicable import duties, taxes, tariffs, and standard customs clearance charges are included in the shipping/checkout charges shown at checkout. Customers should not be required to make additional payment for those charges to receive their order.

Risk of loss and title pass to you once goods are delivered to your nominated address or marked “delivered” by the carrier.

If customs refuses, seizes, destroys, delays, or returns your order for reasons outside our control, no refund will be issued unless the goods are returned to us in saleable condition and a refund is approved in accordance with our Refund Policy. This does not limit any remedy you may be entitled to where the issue is caused by our error or where required by applicable law. If a carrier or customs broker requests payment for duties, taxes, tariffs, or standard clearance charges on a DDP order, please contact us before making payment.

Section 6 – Intellectual property

All content on the Services, including trademarks, text, images, product designs, and arrangements, is owned by or licensed to us and protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, display, or use our content without prior written consent. All rights not expressly granted are reserved.

Section 7 – Optional tools

You may be given access to third-party tools through the Services. These are provided “as is” without warranties, and we have no liability for your use of them. Your use is at your own risk and subject to the provider’s terms.

Section 8 – Third-party links

The Services may contain links to third-party websites. We are not responsible for their content or accuracy. Accessing them is at your own risk, and their policies will apply to any transactions you undertake there.

Section 9 – Relationship with Shopify

Nutrition Lab Sciences is powered by Shopify for our online ecommerce website. Any purchases you make are directly with us. Shopify is not responsible for any transactions or disputes between you and us. You release Shopify from any claims related to your purchases.

Section 10 – Privacy policy

Your personal information is collected and used in accordance with our Privacy Policy and, where applicable, Shopify’s Privacy Policy.

Section 11 – Feedback

If you submit feedback, you grant us a perpetual, worldwide, royalty-free licence to use it for any purpose. You represent that you have the rights to provide it and that it does not infringe on others’ rights.

Section 12 – Errors, inaccuracies and omissions

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate, at any time, without prior notice.

Section 13 – Prohibited uses

You must not use the Services for any unlawful or prohibited purpose, including violating intellectual property rights, harassing others, transmitting viruses, attempting to circumvent security measures, or purchasing products for unlawful import, resale, or misuse.

Section 14 – Termination

We may terminate your access to the Services without notice if you breach these Terms. You remain liable for any outstanding amounts up to the date of termination.

Section 15 – Disclaimer of warranties

Except as required under the ACL or other applicable non-excludable consumer laws, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied.

Section 16 – Limitation of liability

To the fullest extent permitted by law:

  • Our liability for breach of any non-excludable guarantee is limited to resupplying the goods or refunding the purchase price.

  • We are not liable for indirect, incidental, special, or consequential loss, including loss of profits, data, or savings.

 

Section 17 – Indemnification

You agree to indemnify and hold harmless Nutrition Lab Sciences, Shopify, and their affiliates from any claims, losses, or damages arising from your breach of these Terms or misuse of the Services.

Section 18 – Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Section 19 – Waiver; entire agreement

Failure to enforce any provision will not constitute a waiver. These Terms constitute the entire agreement between you and us regarding the Services.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours without restriction.

Section 21 – Governing law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.

Headings are for convenience only and do not affect interpretation.

Section 23 – Changes to terms of service

We may update these Terms from time to time. We will notify you of any material changes as required by law. Your continued use of the Services after changes take effect constitutes acceptance.
